The rule itself is scheduled to take effect on September 15, 2026. Harvard has also clarified that the change does not immediately prevent admitted Fall 2026 students or incoming J-1 scholars from beginning their programmes.

What changes under the new F-1 and J-1 rules?

Under the current system, F-1 and J-1 students and scholars are generally admitted for “duration of status”. This allows them to remain in the US while maintaining the requirements of their academic or exchange programme.

The new system will move to fixed admission periods.

For students entering under the new framework, the admission period can be tied to the programme end date, which could create additional immigration requirements when a programme is extended.

The change also affects the grace period available after the authorised stay.

F-1 students who are already in the US when the rule takes effect retain the existing 60-day grace period, while the new framework reduces the F-1 grace period to 30 days.

Why September 15 is important

The September 15 date is particularly important for international students who are planning travel outside the US.

Returning before the rule takes effect could mean they remain under the existing framework, while those returning afterward may be subject to the new requirements.

Students who need to remain in the US beyond their authorised admission period may also have to apply to USCIS for an extension of stay.

Under the previous system, programme extensions could generally be handled through the educational institution without a separate USCIS extension-of-stay application.

The changes are relevant to Indian students and scholars travelling to or studying in the US on F-1 and J-1 visas.

Anyone planning international travel near September 15 should carefully check their immigration documents and the requirements that will apply when they return.
