From April 1, 2026, companies must give appointment letters to all employees under the new labour laws.

As per the Occupational Safety, Health and Working Conditions Code, 2020, every employer is now legally required to provide a written appointment letter.

If any employee does not have one, the company must issue it within 3 months.

Failing to do so can lead to penalties.

Earlier, written job terms were not properly enforced across all sectors.

This new rule aims to bring clarity and standardisation to employment.

Why This Rule Is Important for Workers

Experts say this move can be a major step toward protecting workers’ rights.

Sandeep Sachdeva highlighted that in their work with over 50,000 workers, 97% did not have appointment letters.

Many workers also lack:

Salary slips

ESIC cards for healthcare

Access to provident fund and overtime benefits

Without an appointment letter, workers often have no legal proof of employment, making it harder to claim their rights.

This rule will help ensure workers get:

Clear job roles and wages

Access to benefits like ESIC and PF

Protection during disputes

What Companies Need to Do

Employers must now:

Issue appointment letters to all employees

Clearly mention salary, working hours, and benefits

Ensure all details match legal requirements

Vinit Kaul noted that companies may take time to fully adjust, as this change could impact wages, benefits, and overall costs.

Still, the goal is to create a more transparent and fair work environment.

Penalties for Not Following the Rule

Companies that fail to follow the rule may face serious penalties:

Fine between ₹2 lakh to ₹3 lakh

Additional penalty of ₹2,000 per day for continued violation

These penalties fall under general provisions of the labour code and will be enforced by central or state authorities.

Bigger Impact: A Step Towards Formal Jobs

This move is part of the government’s effort to formalise employment in India.

Leaders like Narendra Modi and Mansukh Mandaviya have emphasized improving worker protection.

The new rule ensures:

Better documentation

Improved working conditions

Stronger legal rights for employees

What This Means for You

If you are working without an appointment letter, you now have the right to demand one.

This simple document can:

Protect your job security

Help you access benefits

Give you legal backing if issues arise

Overall, this change is a big step toward making jobs in India more secure, transparent, and fair.
