If you are a foreign student or worker in Canada, this update is important. The Canadian government has introduced a new rule that makes things easier for people whose visa status has expired.
In Canada, foreign students and workers are called “temporary residents.” They can stay in the country as long as their study or work permit is valid. But earlier, if this permit expired, they had very limited options.
Now, the rules have changed in their favor.
Big Relief: No Need to Leave Canada
Earlier, if a student or worker lost their legal status, they had to leave Canada before they could come back as a visitor.
This was because the system only allowed them to restore their status in the same category — either as a student or a worker.
But under the new rule announced by IRCC on May 1, 2026, this is no longer required.
Now, eligible people can directly apply to stay in Canada as visitors, even after their status expires. This removes the stress and cost of leaving the country and applying again.
What is “Status Restoration”?
Status restoration is a process that allows foreign nationals to regain their legal status in Canada after it expires.
However, there are some important conditions:
You must apply within 90 days of losing your status
You must stay in Canada while your application is being processed
You must meet all the requirements for the status you are applying for
One important thing to understand is that restoring your status does not automatically allow you to work or study again.
What This Means for Students and Workers
This new rule is especially helpful for students and workers who cannot immediately get a new permit.
Now, instead of leaving Canada, they can apply to stay as visitors and take time to explore their next steps.
This gives them more flexibility and reduces uncertainty.
Earlier, leaving the country was almost unavoidable. But now, staying back and planning your future has become much easier — as long as you apply within the 90-day limit.
