Indian Students can Choose the O-1 Visa

Every year, thousands of Indian students graduate from US universities and begin working through the Optional Practical Training (OPT) program.

Most students in Science, Technology, Engineering, and Mathematics (STEM) can stay and work in the US for up to three years—12 months of OPT plus a 24-month STEM extension.

But once OPT ends, the biggest question remains: How can you continue working in the US?

Many students aim for the H-1B visa, but the lottery system makes it difficult to secure.

Because of this uncertainty, more founders, researchers, engineers, and other skilled professionals are choosing another option—the O-1 visa, which is meant for people with extraordinary ability in their field.

What Is OPT and Why Is It So Important?

OPT allows international students to gain work experience in the US after completing their studies.

However, there is one important condition.

Your job must be directly related to your degree.

For example, a computer science graduate can work as a software engineer but cannot take a job in an unrelated field like accounting.

OPT gives students valuable US work experience without requiring immediate employer sponsorship.

But it is only temporary. If you don’t move to another visa before OPT expires, you generally have to leave the country.

That’s why experts recommend using your OPT period wisely.

Instead of only focusing on your job, you should also build a strong professional profile through projects, research, awards, leadership roles, and industry recognition.

These achievements can help you qualify for future visas like the O-1.

Why More Students Are Looking at the O-1 Visa

The O-1 visa is designed for people who have shown exceptional ability in fields such as science, education, business, arts, athletics, or the entertainment industry.

Unlike the H-1B visa, the O-1 offers several advantages:

No annual lottery system.

No yearly quota on the number of visas.

Applications can be submitted at any time.

The visa is initially valid for three years and can be renewed every year without a fixed limit.

No Labor Condition Application (LCA) is required.

The biggest challenge is proving that you have achieved a high level of professional recognition.

While this sounds difficult, you do not need to be a Nobel Prize winner.

Many startup founders, software engineers, researchers, and product professionals successfully qualify by building a strong portfolio during their OPT period.

How Can You Qualify for an O-1 Visa?

US Citizenship and Immigration Services (USCIS) looks for evidence that an applicant has outstanding achievements in their profession.

A person can qualify by winning a major international award or by meeting at least three of the eight eligibility criteria used by USCIS.

This is why many students spend their OPT period collecting evidence that supports these requirements.

The Eight Main O-1 Visa Criteria

Applicants can strengthen their O-1 profile by meeting some of the following criteria:

Winning prestigious awards or competitions in their field.

Becoming a member of professional organisations that have strict selection standards.

Receiving media coverage or interviews in recognised publications.

Publishing research papers or professional articles.

Serving as a judge at competitions, hackathons, or startup events.

Making significant contributions through patents, research, or impactful products.

Holding an important role at a well-known company.

Earning a salary that is significantly higher than others in the same profession and location.

For many professionals, building evidence in at least three of these areas is enough to create a strong O-1 application.

How to Use Your OPT Period Effectively

The first few months of OPT should focus on getting a job where your work can create measurable achievements.

Choose roles that offer opportunities for recognition, leadership, or meaningful projects.

During the middle phase of OPT, try to publish articles, participate in industry events, judge competitions, apply for professional memberships, and collect awards or recognitions whenever possible.

It is also a good idea to build relationships with senior professionals who may later provide recommendation letters.

If you are on the STEM extension, start preparing your O-1 application well before your OPT ends.

Organise your documents, collect proof of your achievements, and consult an immigration lawyer with experience in O-1 cases.

When Should You Apply?

Your employer or authorised agent must file Form I-129 for the O-1 visa at least 45 days before your intended start date.

However, the application cannot be submitted more than one year in advance.

Since the O-1 visa does not depend on a lottery system, applicants have much greater flexibility in choosing the right time to apply.

With careful planning during the OPT period, many Indian students can successfully move from OPT to an O-1 visa and continue building their careers in the United States.
