Tough New Immigration Rule Hits H-1B Workers and Students

There is concerning news for millions of Indians working or studying in the United States.

A policy from the Donald Trump administration, which had been on hold, has now been approved by the court.

This rule requires all immigrants in the US to register with the government and carry legal documents at all times.

It will also affect those with H-1B visas and students who are already living legally in the country.

What Is the New Rule?

The US Department of Homeland Security (DHS) recently issued a notice saying that all non-citizens aged 18

and above must carry valid identity documents at all times. If they fail to do so, they could face legal consequences, with no leniency.

The Court’s Decision

The rule was approved after US District Judge Trevor McFadden of Washington DC ruled in favor of the policy.

He stated that the organizations challenging the rule could not prove that it would cause serious harm. As a result, the DHS was allowed to enforce this rule.

Who Will Be Affected?

People who already have a Green Card, I-94 Entry Record, Employment Authorization Document (EAD), or Border Crossing Card are considered registered and will not be directly affected.

However, H-1B visa holders, F-1 students, and their dependents will now need to carry their documents with them at all times.

Children under 14 will need to re-register within 30 days of turning 14 and provide fingerprints.

Why Is This Rule Controversial?

Many organizations, including the National Immigration Law Center and the United Farm Workers of America, have opposed the rule.

They argue that it forces immigrants into a difficult situation where they must either register and risk deportation or avoid registration and face penalties.

Concerns for H-1B Visa Holders

Each year, thousands of Indians go to the US on H-1B visas to work in tech companies, startups, and multinational corporations.

Now, these workers will be required to carry important documents such as their visa, passport, and work permit with them 24/7. Even a minor mistake could result in serious problems.
