If you’ve been selected in the H-1B 2027 cap, that’s great news—but the process isn’t over yet.

The next step is for your employer to file an official petition with the United States Citizenship and Immigration Services (USCIS).

Companies have 90 days starting April 1, 2026, to submit this petition.

The last date to file is June 30, 2026.

Remember, selection only gives you the chance to apply—it does not guarantee approval.

Key Rules You Must Know This Year

The H-1B process has changed significantly for 2027.

One major update is the shift to a “beneficiary-centric selection system.”

This means each applicant is counted only once, even if multiple employers apply for them.

Employers must now submit:

Proof of the applicant’s valid passport or travel document

Strong evidence to justify the salary (wage level) offered

These details are now critical for approval.

New Wage-Based System Explained

The H-1B process now focuses more on skills and salary levels.

There are four wage levels:

Level 1 – Entry-level workers

Level 2 – Experienced workers

Level 3 – Fully skilled professionals

Level 4 – Experts and senior professionals

Higher-skilled and higher-paid candidates may get priority under this new system.

Higher Fees You Should Be Aware Of

Applying for H-1B has become more expensive.

New Form I-129 Brings Stricter Checks

The Form I-129, used to file H-1B petitions, has been updated.

From April 1, 2026, only the new version (02/27/26 edition) will be accepted.

$100,000 Fee: A Major Change

One of the biggest updates is a new $100,000 fee for employers hiring H-1B workers.

Earlier, the total cost was under $10,000—now it can go above $100,000.

However, some categories like certain students and workers may be exempt from this fee.
