There is good news for homebuyers in Uttar Pradesh. UP RERA has introduced new rules that allow buyers to file complaints even against projects that are not registered with RERA.
These new rules came into effect on March 25 and are part of the 10th amendment to the RERA rules.
Complaints Now Allowed for All Projects
Earlier, if a project was not registered with RERA, buyers did not have a proper legal way to file complaints. Many builders took advantage of this and avoided registering their projects.
Now, under the new rules, buyers can directly file complaints with UP RERA against any project, whether it is registered or not.
How Action Will Be Taken
RERA will first check whether the project needed to be registered. If the builder is found to have violated the rules, action will be taken against them. At the same time, the buyer’s complaint will also be heard.
This change removes the legal gap that existed earlier.
What Buyers Need to Do
Since such projects may not have complete documents, buyers might need to provide extra details while filing a complaint.
To make the process easier, RERA may introduce a new form, likely called Form M.
Limit on Property Transfer Charges
Another important change is related to transfer charges. Builders will no longer be allowed to charge high or random fees for property transfers.
Maximum ₹1,000 for transfer to a family member
Maximum ₹25,000 for transfer to another person
Easier Property Transfer Process
The process of transferring property has also been simplified. There is no need to create a new agreement anymore. Instead, changes will be made in the existing agreement.
This will reduce paperwork and make the process faster. Overall, these new rules provide better protection for homebuyers.
