H-1B Visa Holders must Follow this Rule after Starting Work

H-1B Visa Rules require new workers in the US to complete several important formalities after starting their jobs.

For Indians who have recently received an H-1B visa and started work from October 1, checking immigration records, completing employment verification and handling tax paperwork are among the key steps.

These formalities can help ensure that employment, immigration status, salary reporting and tax records remain accurate.

 H-1B Visa Rules: Check Your I-94 First

After entering the US, new H-1B workers should check their Form I-94 record.

The record should correctly show the class of admission, authorised stay date and H-1B status.

Any error in the name, passport number, immigration status or permitted stay date should be addressed rather than ignored.

 Complete Form I-9 for Your New Job

Form I-9 is an important part of the employment onboarding process. It is used to verify a worker’s identity and eligibility to work legally in the US.

An H-1B worker generally needs to complete their part of the form by the first day of employment.

The employer then has to complete the required verification of identity and employment authorisation within the applicable period.

 Apply for a Social Security Number

A Social Security Number, or SSN, is important for workers in the US.

Employers use it for salary reporting and tax-related purposes, while it can also be required for banking and other financial activities.

New Indian workers should apply for an SSN through the Social Security Administration.

If the SSN card has not arrived yet, an eligible foreign worker can still begin employment while the application is being processed.

Fill Out Form W-4 for Tax Withholding

New employees also need to complete Form W-4 during the onboarding process.

The information provided on the form helps the employer determine how much federal income tax should be withheld from the worker’s salary.

H-1B status alone does not determine whether a person is treated as a resident or non-resident alien for tax purposes.

New workers who are unsure about their tax status can seek guidance from their HR or payroll team or a tax professional.

Depending on the state where they live or work, employees may also need to complete a state tax form.
