Uttarakhand Gutkha Ban has come into effect from October 13, 2026, prohibiting the manufacture, storage, distribution and sale of gutkha, pan masala and other food products containing tobacco or nicotine across the state.
The one-year restriction has been ordered by Food Safety and Drug Administration Commissioner Vinay Shankar Pandey in the interest of public health.
The order applies to the prohibited products regardless of the name under which they are marketed.
This means the restriction covers more than retail sales, extending to the supply chain and storage of products containing the banned ingredients.
Uttarakhand Gutkha Ban Covers Manufacturing and Sale
The state government has issued the order under the Food Safety and Standards Act, 2006, and the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011.
Regulation 2.3.4 prohibits the use of tobacco and nicotine as ingredients in food products.
The latest order seeks to enforce this restriction against products such as gutkha and pan masala that contain these substances.
The ban covers four key activities: manufacturing, storage, distribution and sale.
Businesses involved in these activities will need to comply with the order for the duration of the restriction.
The prohibition applies throughout Uttarakhand, rather than being limited to a particular city or district. Authorities have been instructed to take the necessary steps to implement the order.
Why Has Uttarakhand Banned Tobacco-Laced Pan Masala?
Public health concerns are central to the decision. Tobacco and nicotine consumption is associated with serious health risks, and smokeless tobacco products remain a concern for health authorities.
The commissioner issued the restriction after noting the continued use of tobacco and nicotine in products such as gutkha and pan masala, despite the existing food safety regulations.
By restricting these products at multiple stages, from production to sale, the state aims to limit their availability in the market.
The order also reinforces the existing rule that tobacco and nicotine should not be used as ingredients in food products.
When Does the One-Year Ban End?
The order took effect on October 13, 2026, and is scheduled to remain in force for one year from the date of issuance.
The restriction therefore runs into October 2027, unless the applicable legal position or a subsequent government order changes its operation.
The ban is not limited to products sold under familiar gutkha or pan masala labels.
Other food products containing tobacco or nicotine are also covered, irrespective of the name used to market them.
Retailers, distributors, storage operators and manufacturers should review their inventory and business activities to ensure compliance.
Consumers should also be aware that the restriction applies across the state.
Uttarakhand Has Imposed Similar Bans Before
Uttarakhand has taken similar steps in previous years, including 2013, 2015 and 2019.
Such restrictions have been issued periodically under food safety provisions that allow authorities to prohibit specified food products in the interest of public health.
The latest order follows the same broad regulatory approach, with a fresh one-year period beginning in October 2026.
Enforcement will be important to the effectiveness of the restriction.
Authorities will need to monitor manufacturing, storage, distribution and retail outlets to ensure the prohibited products are not sold or supplied within the state.
For now, the order establishes a statewide restriction on gutkha, pan masala and other food products containing tobacco or nicotine for one year.
Businesses operating in Uttarakhand should follow the notification and any further instructions issued by the state authorities.
