Borrowers who have missed loan payments will get stronger protection from unfair recovery practices.
The Reserve Bank of India (RBI) has issued new guidelines for loan recovery agents, setting clear rules on how banks and recovery agencies can contact customers.
The new rules will come into effect from January 1, 2027.
Under the revised framework, commercial banks will have to create a formal loan recovery policy and ensure that recovery processes remain fair, transparent and respectful.
Who Are Loan Recovery Agents?
A loan recovery agent is a person or agency hired by a bank to contact borrowers when their loan payments become overdue.
Their job is to help banks recover unpaid dues from customers.
A loan becomes overdue when a borrower fails to pay an instalment by the scheduled due date.
However, the RBI has clarified that recovery of dues cannot involve harassment, intimidation or misuse of customer information.
Why Has RBI Introduced New Recovery Rules?
The RBI aims to make the loan recovery process more organised and customer-friendly.
The new guidelines define:
When recovery agents can contact borrowers
How they can communicate
What information they can use
What recovery methods are allowed
The objective is to ensure that while borrowers remain responsible for repaying their loans, banks recover dues through a proper and accountable process.
Key Changes Under RBI Loan Recovery Rules 2027
Banks Must Verify Recovery Agencies
Banks will now have to conduct proper checks before appointing recovery agencies.
Recovery agents will also need certification from the Indian Institute of Banking and Finance (IIBF).
This will ensure that agents understand banking rules, borrower rights and acceptable recovery practices before dealing with customers.
Banks Must Publish Recovery Agency Details
Banks will have to display the list of their authorised recovery agencies on their websites.
This will help borrowers verify whether the person contacting them is a genuine recovery agent or someone making unauthorised claims.
One-Day Notice Before Agent Visits
Before a recovery agent visits a borrower, the customer must receive information at least one day in advance.
This will allow borrowers time to understand the outstanding dues and prepare for the discussion.
Recovery Calls Must Be Recorded
Banks will have to maintain recordings of recovery-related calls for six months.
These recordings can help investigate complaints related to improper communication or misconduct by recovery agents.
Banks Cannot Encourage Aggressive Recovery
Banks will not be allowed to set recovery targets that force agents to use unfair methods.
The RBI wants to prevent situations where agents pressure or harass borrowers just to meet collection targets.
Strict Rules on Device Locking for Loan Recovery
The RBI has also introduced limits on remotely restricting mobile phones, tablets or laptops.
Banks can use device-locking technology only when the loan was specifically taken to purchase that device.
Even then, restrictions cannot be imposed immediately.
A device cannot be restricted before the loan remains overdue for 30 days. Complete restrictions can only be applied after the loan remains unpaid for 60 days.
Essential features like:
Incoming calls
SMS services
Emergency SOS facility
cannot be disabled.
Once the borrower clears the dues, the device must be unlocked within one hour.
Banks May Have to Pay Compensation for Delays
If a bank fails to unlock a device within the required time after repayment, it will have to compensate the borrower.
The compensation amount will be Rs 250 per hour of delay.
This rule aims to ensure that lenders quickly restore access once the borrower has cleared the pending amount.
Recovery Agents Cannot Misuse Personal Data
The RBI has also placed restrictions on the use of borrower information.
Recovery activities cannot involve unauthorised use of personal data or intrusive methods that violate customer privacy.
Fixed Timings for Recovery Calls
Recovery agents will only be allowed to contact borrowers between:
8:00 AM and 7:00 PM
The RBI has also prohibited:
Abusive language
Threats
Publicly shaming borrowers on social media
The regulator has made it clear that loan recovery must follow professional and respectful practices.
Banks Must Provide Complaint Support
Every bank will need to create a grievance redressal system for loan recovery-related complaints.
Borrowers will be able to raise concerns if they feel recovery agents have violated the RBI guidelines.
With these new rules, the RBI aims to create a balance between protecting borrowers’ rights and helping banks recover genuine outstanding dues.
