Who Are Temporary Residents?
Foreign students and workers in Canada are known as temporary residents. They are allowed to stay in the country as long as their study permit or work permit remains valid.
Earlier, if a student or worker lost their legal status, they usually had to leave Canada before returning as a visitor. This created problems for many people who wanted to continue staying in the country legally.
Now, the Canadian government has relaxed this rule.
What Has Changed Under the New Rule?
According to the updated guidelines, people whose worker or student status has expired can now apply to restore their status as visitors while staying inside Canada.
Previously, restoration was only allowed in the same category. For example:
Workers could only apply again as workers
Students could only apply again as students
If they wanted visitor status, they had to first leave Canada and then re-enter the country.
That requirement has now been removed.
What Is “Status Restoration”?
Status restoration is a process that allows foreign nationals to regain their temporary resident status after it expires.
However, there are some conditions:
The person must apply within 90 days of losing their status
They must stay in Canada while waiting for a decision
They must meet all the requirements for the new status they are applying for
It is important to note that restoration of status does not automatically allow someone to work or study again.
