The H-1B spouse work permit rules in the US are changing, bringing new concerns for Indian professionals and their families.
The US Department of Homeland Security (DHS) has finalised a rule ending automatic extensions of certain Employment Authorization Documents (EADs), meaning eligible applicants may face a gap in their permission to work while renewal applications are pending.
The change is important for spouses of H-1B visa holders who depend on work permits to maintain their employment in the United States.
However, the end of automatic extensions does not mean that all H-4 spouses have lost their eligibility to apply for work authorisation.
H-1B Spouse Work Permit Rules and Key Changes
Under the new rule, filing an eligible work permit renewal application will no longer automatically extend the validity of the existing Employment Authorization Document for applications covered by the policy.
The measure makes permanent the interim rule introduced in October 2025.
The policy is intended to allow immigration authorities to complete eligibility checks and screening before granting a new period of work authorisation.
Previously, eligible applicants could receive automatic extensions of up to 540 days while their renewal applications were being processed.
The final rule was published in the Federal Register on October 14, 2026, and took effect on the same date.
It retains automatic extensions for qualifying renewal applications filed before October 30, 2025, subject to the applicable requirements.
Why H-4 Spouses Could Face Work Disruptions
For eligible H-4 spouses, an EAD is an important document that allows them to work in the US.
If a renewal application remains pending after the current document expires, the loss of an automatic extension could temporarily interrupt their employment, depending on their circumstances and whether another basis for work authorisation applies.
Such a gap could affect salaries, employee benefits and career continuity.
Employers may also face difficulties retaining workers who cannot legally continue working during a delay in the renewal process.
The rule does not remove the underlying eligibility of H-4 dependants to apply for or renew work permits.
Instead, it changes the automatic extension arrangements for covered applications, making it important for applicants to understand which rules apply to their individual cases.
What Applicants Should Know About the New Rule
Applicants should check their EAD expiry dates and the status of their renewal applications well before their current authorisation expires.
They should also confirm whether their application qualifies for any exception or transitional provision rather than assuming that submitting a renewal automatically allows them to continue working.
The new rule does not apply identically to every immigration category or situation.
Certain work authorisations may continue under separate legal provisions, while some applicants may qualify for exceptions established by law or specific government notices.
H-1B workers and their spouses should therefore review official US Citizenship and Immigration Services guidance and seek qualified immigration advice if their employment or legal status could be affected.
H-1B spouse work permits may also be affected by broader immigration scrutiny, but applicants should distinguish the final EAD rule from any separate proposals concerning visa-extension reviews.
The requirements and effective dates of each measure should be checked independently.
The key issue for affected families is timing: a pending renewal may not provide the same automatic protection it once did.
Planning ahead and confirming current eligibility can help reduce the risk of an unexpected interruption to employment.
