Homebuyers Can Report Poor Flat Quality Post-Possession

Madhubala’s Struggle for Compensation

In 1996, Madhubala received a flat in her late husband’s name. However, she had to wait many years before finally taking possession in 2019.

By then, the flat was in terrible condition, with poorly constructed walls and an overall shabby appearance.

Madhubala had to use her savings to repair the flat, which caused her significant financial loss. In 2020, she decided to take action

and filed a complaint with the District Consumer Commission, demanding Rs 20 lakh in compensation.

Initially, her complaint was rejected by the District Consumer Commission, which argued that she was no longer a consumer since she had already received the flat.

Undeterred, Madhubala appealed the decision to the State Consumer Commission.

A Landmark Ruling for Homebuyers

The State Consumer Commission, led by chairperson Justice Sangeeta Dhingra Sehgal, ruled that consumers have the right to seek compensation for poor-quality service even after taking possession of a property.

The commission stressed that builders are responsible for delivering good-quality homes and must compensate buyers if the property does not meet standards.

The State Commission overruled the District Commission’s decision and sent the case back for further review.

This ruling not only upheld Madhubala’s fight for justice but also sent a strong message to builders about their responsibilities.
